Terms of Service

By creating a Fus1on Studios Account, purchasing a license, submitting a support ticket, or otherwise using fus1on.host or any product that signs in with a Fus1on Studios Account (together, the "Service"), operated by Fus1on Studios, an individual operating as a sole proprietorship based in Alberta, Canada ("we," "us," "our"), you agree to these Terms of Service. If you don't agree, don't use the Service.

Fus1on Studios operates a Fus1on Studios Account system used to sign in to our products (currently Overseer, with more planned), along with the licensing, billing, and support systems those products rely on. The Service is under active development - features, limits, and pricing may change, and we'll do our best to communicate significant changes.

You create a Fus1on Studios Account with an email address and password. You're responsible for keeping your credentials secure and for all activity under your account. Tell us right away if you suspect unauthorized access. You must verify your email address before your account can be linked to other Fus1on Studios products.

Your Fus1on Studios Account can be used to sign in to other Fus1on Studios products via "Sign in with Fus1on Studios." When you approve a product's request to connect, we share basic profile information (your account ID, name, email, and email verification status) with that product - see your dashboard's Connected Apps list for what's currently linked, and disconnect at any time by contacting us.

Paid tiers are billed through Stripe on a recurring subscription basis unless explicitly sold as a one-time lifetime license. Subscriptions renew automatically until cancelled; you can manage or cancel from the Manage Billing link on your Licenses page at any time. Except where required by law, payments are non-refundable - cancelling stops future renewals but doesn't refund the current billing period. Reach out via Contact Us or a support ticket if something's gone wrong - we handle these case by case.

A license key activates a product on up to your tier's server limit. Lifetime (non-expiring) keys may be transferred to another owner by the current paying customer; subscription-based keys, tied to a Stripe payment method, may not. We may revoke a key obtained fraudulently or in violation of these Terms.

You agree not to:

• Use the Service for anything illegal.
• Attempt to bypass, disable, or reverse-engineer license enforcement, authentication, or other access controls.
• Abuse, spam, or overload the Service, including automated bulk requests outside normal use.
• Resell, sublicense, or redistribute access to the Service except through the official Reseller Program.

Reseller applications are reviewed and approved at our discretion. Approved resellers purchase license keys at a wholesale discount and may set their own pricing, bundling, and terms with their own customers, with one condition: keys may not be resold below our then-current public list price for the equivalent plan, as shown on our Pricing page. Resellers are independent - you're responsible for your own customer relationships, support, and any refunds you offer, unless we've separately agreed otherwise in writing. We may suspend or revoke reseller status for violating this section.

Content you submit - support tickets and contact form messages - may be used to operate, provide support for, and improve the Service.

The Service relies on Stripe, MongoDB Atlas, Resend, Discord (for notification webhooks), and Cloudflare, among others, each governed by their own terms. We aren't responsible for their availability or conduct.

Fus1on Studios owns the Service and all associated software, branding, and content. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service per your license tier - nothing more.

We may suspend or terminate access for violating these Terms, non-payment, or abuse of the Service. You may stop using the Service, deactivate your license, or request account deletion at any time.

The Service is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, Fus1on Studios is not liable for any indirect, incidental, or consequential damages, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose.

We may update these Terms as the Service evolves. Material changes will be reflected by an updated "Last updated" date above; continued use after a change means you accept the updated Terms.

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any dispute not resolved informally will be subject to the exclusive jurisdiction of the courts of Alberta.
